Lord Justice Jackson Costs Review - The impact on ADR and Mediation
Lord Justice Jackson's Final Report following his Review of Civil Litigation Costs was published on 14 January 2010. His proposals include a wide-ranging package of reforms designed to bring costs under control and make them fairer.
The role of Alternative Dispute Resolution plays a key part within the Review. Here is an extract on the potential role of ADR from the Review. "Alternative dispute resolution ("ADR") (particularly mediation) has a vital role to play in reducing the costs of civil disputes, by fomenting the early settlement of cases. I therefore recommend that:
- There should be a serious campaign to ensure that all litigation lawyers and judges are properly informed of how ADR works, and the benefits that it can bring.
- The public and small businesses who become embroiled in disputes are also made aware of the benefits of ADR.

Speaker Profile - District Judge, Ronald Dudley
District Judge Ronald Dudley has been involved in family and civil litigation both as legal practitioner and judge for over 30 years. He has lectured in civil litigation at the College of Law and was Under Sheriff of Rutland for over 10 years. Formerly an associate of the Chartered Institute of Arbitrators he has taken an active role in the development of In-Court mediation services. He was the judge in charge of the pilot scheme to launch the National Mediation Helpline at Southend-on-Sea County Court where he sits and has been active in promoting the Court's Small Claims Mediation Service.
Speaker Profile - Simon Madden, Ministry of Justice
Simon has held a number of operational posts in the county courts before moving into this area of policy.
The team Simon now leads is responsible for the Small Claims Mediation Service in the county courts and the National Mediation Helpline.
Simon represents the Ministry of Justice on the board of the Civil Mediation Council and is also a member of the Civil Justice Council Dispute Resolution Committee.
