Figures out today from the Ministry of Justice show that in the last quarter, April to June 2014, 74,400 Tribunal case recipients. This is 71% lower than in the same quarter in 2013, and the lowest since this statistics series began in 2008/09. There were also 35% less cases disposed of in April to June 2014 than in the same period in 2013. Another particularly striking statistic is that single claims are down 1/3 on the quarter January to March 2014. The introduction of the Acas Early Conciliation process in May 2014 is likely contributing to this situation, in addition to the continuing impacts of the Employment Tribunal fees introduced last year.
On Monday, Labour announced plans to scrap the “unfair” employment tribunal system. Shadow business secretary Chuka Umunna says the fees are preventing people from getting justice they are entitled to. Umunna says the system is unfair, unsustainable and has resulted in unsustainable costs.
Business organisations do not agree, saying that whilst the system could be improved, abandoning it is a mistake.
Recent reforms which encourage early resolution of disputes are a step in the right direction, and fees to make a claim are a vital part of that.
